Memo Agreement
Established in June of 2007, the Memo Agreement is designed for
those individuals being introduced to the criminal justice system
for the first time. Each case is reviewed on a case-by-case
basis, and it is at the discretion of the chief prosecutor in each
court whether or not a defendant is offered a Memo Agreement. Criteria
for eligibility for the Memo Agreement include the following:
- misdemeanor cases ONLY,
- and first-time offenders, i.e. no prior contact with the criminal justice system.
*The offenses listed below are NOT eligible for the Memo Agreement:
- Public Lewdness
- Indecent Exposure
- Family Violence cases
- DWI (Driving While Intoxicated)
- Prostitution

Defendants participating in the Memo Agreement must successfully complete all terms of the agreement (examples include restitution, community service hours, course work, etc.) within the allotted period of time. Upon completion of the requirements, the defendant’s case is dismissed.
